Terms of Service
Article 1 (Scope of Application)
- The accommodation contract and related agreements that this hotel enters into with the guest to stay shall be subject to the provisions of these terms and conditions, and any matters not provided for in these terms and conditions shall be governed by laws, regulations and generally accepted practices.
- In the event that the Hotel enters into a special agreement with a Guest, provided such special agreement does not violate laws, regulations or customary practices, notwithstanding the provisions of the preceding paragraph, such special agreement shall take precedence.
Article 2 (Application for Accommodation Contract)
- Anyone who wishes to apply for an accommodation contract with the Hotel must provide the Hotel with the following particulars:
- Guest name
- Date of stay and expected arrival time
- Accommodation fees (in principle, based on the basic accommodation fees in Appendix 1)
- Other matters deemed necessary by the hotel
- If a Guest requests, during his/her stay, to extend his/her stay beyond the date specified in subparagraph 2 of the preceding paragraph, our Hotel will treat it as if he/she had applied for a new Accommodation Contract at the time such request was made.
Article 3 (Establishment of Accommodation Contracts, etc.)
- The accommodation contract shall be deemed to have been concluded when the hotel accepts the application as described in the previous article. However, this shall not apply when the hotel proves that it did not accept the application.
- When an accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, an application fee set by the hotel, up to the basic accommodation fee for the period of stay, shall be paid by the date specified by the hotel.
- The application fee shall first be applied to the accommodation fee finally payable by the Guest, and in the event of the occurrence of a situation to which the provisions of Articles 6 and 18 apply, it shall be applied in the order of penalty charges and compensation, and the remainder, if any, shall be refunded at the time of payment of the accommodation fee as provided for in Article 12.
- If the application fee stipulated in paragraph 2 is not paid by the date specified by the hotel in accordance with the provisions of the same paragraph, the accommodation agreement will become void. However, this will only apply if the hotel has so notified the guest when specifying the due date for payment of the application fee.
Article 4 (Special agreements not requiring payment of application fees)
- Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special agreement pursuant to which the application fee stipulated in the same paragraph is not required after the contract has been concluded.
- If, when accepting an application for an Accommodation Contract, the Hotel has not requested the payment of the application fee as stipulated in Paragraph 2 of the preceding Article and has not specified a due date for the payment of the application fee, it will be treated as if the Hotel had accepted a special contract as stipulated in the preceding paragraph.
Article 5 (Refusal to Conclude an Accommodation Contract)
Our hotel may refuse to enter into an accommodation contract in the following cases:
- When the application for accommodation does not conform to these terms and conditions.
- When the Hotel is fully booked and no guest rooms are available.
- When the person seeking accommodation is deemed to be in danger of engaging in conduct that will violate the provisions of the law, the public order or good morals in regard to his/her accommodation.
- When the person seeking accommodation is deemed to fall under any of the following items (a) to (c):
- An organized crime group as defined in Article 2, Paragraph 2 of the Law Concerning Prevention of Unjust Activities by Organized Crime Group Members (Law No. 77 of 1991) (hereinafter referred to as an “organized crime group”), an organized crime member as defined in Article 2, Paragraph 6 of the same Law (hereinafter referred to as an “organized crime member”), an associate member of an organized crime group, or a person related to an organized crime group, or other anti-social forces.
- When a corporation or other organization whose business activities are controlled by an organized crime group or an organized crime member
- A corporation in which any of its directors is a member of an organized crime group
- When a person seeking accommodation behaves in a manner that is extremely disruptive to other guests.
- When the person seeking accommodation can be clearly detected as carrying an infectious disease.
- When violent demands are made in relation to the accommodation, or an unreasonable burden is requested.
- When it is impossible to provide accommodation due to natural disasters, malfunctions of facilities, or other unavoidable reasons.
- When the case falls under the provisions of Article 4 of the Oita Prefecture Hotel and Inn Business Act Enforcement Ordinance.
Article 6 (Guest’s Right to Cancel Accommodation Contract)
- Guests may cancel their accommodation contract by notifying the hotel.
- In the event that a guest cancels the accommodation contract in whole or in part due to reasons attributable to the guest (except in the event that the hotel has specified a due date for the application fee and requested payment pursuant to the provisions of Article 3, Paragraph 2 and the guest cancels the accommodation contract prior to payment), the hotel shall charge a penalty as listed in Attached Table 2. However, in the event that the hotel has accepted a special agreement as set forth in Article 4, Paragraph 1, this shall apply only when the guest has been notified of the obligation to pay the penalty when the guest cancels the accommodation contract, in accepting such special agreement.
- If a guest does not arrive by 8 p.m. on the day of the stay without contacting the hotel (or by two hours after the expected arrival time if the guest has stated the expected arrival time in advance), the hotel may regard the accommodation contract as having been cancelled by the guest.
Article 7 (Right of the Hotel to Cancel Contract)
- Our hotel may cancel the accommodation contract in the following cases.
- When the Guest is deemed liable to conduct himself/herself in a manner that will violate the laws, public order or good morals in regard to his/her accommodation, or when he/she is deemed to have conducted such conduct.
- When the Guest is deemed to be one of the following (a) to (c):
- Organized crime group, organized crime group member, associate member of an organized crime group, or related person to an organized crime group or other antisocial forces
- When a corporation or other organization whose business activities are controlled by an organized crime group or an organized crime member
- A corporation in which any of its directors is a member of an organized crime group
- When the Guest behaves in a manner that causes significant nuisance to other Guests.
- When the Guest can be clearly detected as carrying an infectious disease.
- When violent demands are made in relation to the accommodation, or an unreasonable burden is requested.
- When it is impossible to provide accommodation due to a natural disaster or other force majeure event.
- When the case falls under the provisions of Article 4 of the Oita Prefecture Hotel and Inn Business Act Enforcement Ordinance.
- When the Guest smokes in bed, tampers with fire-fighting equipment, or fails to comply with other prohibited activities stipulated by the Hotel (limited to those necessary for fire prevention).
- When the Hotel has cancelled the Accommodation Contract in accordance with the provisions of the preceding paragraph, the Hotel
shall not charge the Guest for any accommodation services which he/she has not yet received.
Article 8 (Accommodation Registration)
- Guests will be required to register the following particulars at the hotel front desk on the day of their stay:
- Name, age, sex, address and occupation of the guest
- For foreigners, nationality, passport number, place of entry and date of entry
- Departure date and scheduled departure time
- Other matters deemed necessary by the hotel
- If the Guest intends to pay the charges prescribed in Article 12 by any means other than Japanese currency, such as traveller’s cheques, accommodation coupons or credit card, these shall be presented in advance at the time of registration prescribed in the preceding Paragraph.
Article 9 (Room Occupancy Hours)
- Guests may use the guest rooms of the hotel from 3:00 pm to 11:00 am the following morning. However, in the case of consecutive stays, guests may use the guest rooms all day, except on the days of arrival and departure.
- Notwithstanding the provisions of the preceding paragraph, the hotel may accommodate guests using the rooms outside the hours specified in the same paragraph. In this case, the following additional fees will be charged.
- Up to 3 hours over, 1/3 of the room charge (or 30% of the room charge)
- Up to 6 hours over, 1/2 of the room charge (or 50% of the room charge)
- For over 6 hours, the full room charge (or 100% of the room charge) will be charged.
(3. The room charge in the preceding paragraph shall be 100% of the basic accommodation fee.)
Article 10 (Observance of Terms of Use)
Guests are required to observe the hotel usage regulations established by the hotel and posted within the hotel premises.
Article 11 (Business Hours)
- The opening hours of our main facilities are as follows. Detailed opening hours of other facilities will be provided in the pamphlets provided, on notices posted in various locations, in the service directories in the guest rooms, etc.

- The hours stated in the preceding paragraph may be subject to temporary change due to unavoidable circumstances. In such cases, we will notify you by appropriate means.
Article 12 (Payment of Fees)
- The breakdown of the accommodation fees, etc. to be paid by the Guest shall be as set forth in Attached Table 1.
- Payment of accommodation fees, etc. as stipulated in the preceding paragraph shall be made at the front desk at the time of the guest’s departure or upon request by our hotel in currency or by any other means acceptable to our hotel, such as traveller’s cheques, accommodation vouchers, or credit card.
- Accommodation fees will be charged even if the Guest voluntarily does not stay in the accommodation facility after the Hotel has provided the guest room to the Guest and made it available for use.
Article 13 (Responsibilities of the Hotel)
Our hotel will compensate the guest for damages caused to the guest in the fulfillment or non-fulfillment of the accommodation contract and related agreements, unless such damages are due to reasons not attributable to our hotel.
Article 14 (Handling when contracted rooms cannot be provided)
- When the Hotel is unable to provide a contracted room to a Guest, it will, with the Guest’s consent, arrange accommodation of the same standards elsewhere where possible.
- Notwithstanding the provisions of the preceding paragraph, if the hotel is unable to arrange other accommodations for the guest, the hotel will pay the guest a compensation fee equivalent to the breach of contract charge, which will be applied to the amount of damages. However, if the hotel is unable to provide a room due to reasons beyond the hotel’s control, the hotel will not pay the compensation fee.
Article 15 (Handling of Deposited Items, etc.)
- When loss, breakage or other damage occurs to goods, cash or valuables deposited at the front desk by the guest, the hotel will compensate for the damage, except in cases where this is due to force majeure. However, in the case of cash and valuables, if the hotel requests a declaration of their type and value and the guest fails to do so, the hotel will compensate for the damage up to a maximum of 100,000 yen.
- If the loss, breakage or other damage occurs due to the intention or negligence of the hotel to any goods, cash or valuables brought into the hotel by the guest but not deposited at the front desk, the hotel will compensate for such damage. However, for any items for which the guest has not reported the type and value in advance, the hotel will compensate up to a maximum of 100,000 yen, except in cases where the loss is due to the intention or gross negligence of the hotel.
Article 16 (Care of Guest’s Baggage and Belongings)
- When the baggage of the Guest is brought into the Hotel prior to his/her stay, the Hotel shall be responsible for storing it only when such request has been approved in advance and shall hand it over to the Guest at the front desk at the time of his/her check-in.
- If a guest’s baggage or belongings are found left behind at the hotel after check-out, and the owner is identified, the hotel will contact the owner and ask for instructions. However, if there is no instruction from the owner or the owner is not identified, the hotel will store the item for seven days, including the day it was found, and then deliver it to the nearest police station.
- The liability of our hotel regarding the custody of the Guest’s baggage and belongings in the cases of the previous two paragraphs shall be in accordance with the provisions of the previous Article, Paragraph 1 in the case of Paragraph 1, and in accordance with the provisions of the same Article, Paragraph 2 in the case of the previous paragraph.
Article 17 (Liability for Parking)
When guests use our hotel’s parking lot, regardless of whether the guest has deposited the vehicle key with us or not, our hotel is merely lending the space and is not responsible for the management of the vehicle. However, if the hotel causes damage through its intention or negligence in managing the parking lot, the hotel will be liable for compensation.
Article 18 (Guest Liability)
When the Guest causes damage to the Hotel through intent or negligence on the part of the Guest, the Guest shall compensate the Hotel for such damage.
